Prodej tab\u00E1kov\u00FDch v\u00FDrobk\u016F a tab\u00E1kov\u00FDch pot\u0159eb pomoc\u00ED prodejn\u00EDch automat\u016F, u nich\u017E nelze vylou\u010Dit prodej osob\u00E1m mlad\u0161\u00EDm 18 let v\u011Bku, je zak\u00E1z\u00E1n. Ve\u0161ker\u00E9 dal\u0161\u00ED formy prodeje, p\u0159i kter\u00FDch nen\u00ED mo\u017Eno ov\u011B\u0159it v\u011Bk kupuj\u00EDc\u00EDho, jsou zak\u00E1z\u00E1ny.

Zakazuje se prodej v\u00FDrobk\u016F napodobuj\u00EDc\u00EDch tvar a vzhled tab\u00E1kov\u00FDch v\u00FDrobk\u016F ve form\u011B potravin\u00E1\u0159sk\u00FDch v\u00FDrobk\u016F nebo hra\u010Dek.

\r\n

(1) Prod\u00E1vat tab\u00E1kov\u00E9 v\u00FDrobky osob\u00E1m mlad\u0161\u00EDm 18 let se zakazuje.

\r\n

(2) Prodej tab\u00E1kov\u00FDch v\u00FDrobk\u016F na kulturn\u00EDch, spole\u010Densk\u00FDch a sportovn\u00EDch akc\u00EDch ur\u010Den\u00FDch pro osoby mlad\u0161\u00ED 18 let je zak\u00E1z\u00E1n.

\r\n

(1) Provozovatel je povinen na m\u00EDstech prodeje tab\u00E1kov\u00FDch v\u00FDrobk\u016F um\u00EDstit pro kupuj\u00EDc\u00EDho zjevn\u011B viditeln\u00FD text z\u00E1kazu prodeje tab\u00E1kov\u00FDch v\u00FDrobk\u016F osob\u00E1m mlad\u0161\u00EDm 18 let; text mus\u00ED b\u00FDt po\u0159\u00EDzen v \u010Desk\u00E9m jazyce \u010Dern\u00FDmi tiskac\u00EDmi p\u00EDsmeny na b\u00EDl\u00E9m podklad\u011B, o velikosti p\u00EDsma nejm\u00E9n\u011B 5 cm.

\r\n

(2) Osoba prod\u00E1vaj\u00EDc\u00ED tab\u00E1kov\u00E9 v\u00FDrobky mus\u00ED b\u00FDt star\u0161\u00ED 18 let, pokud se nejedn\u00E1 o \u017E\u00E1ka p\u0159ipravuj\u00EDc\u00EDho se soustavn\u011B na budouc\u00ED povol\u00E1n\u00ED v oborech hotelnictv\u00ED a turismus, kucha\u0159-\u010D\u00ED\u0161n\u00EDk a prodava\u010D.

a) na ve\u0159ejn\u00FDch m\u00EDstech, kter\u00FDmi jsou uzav\u0159en\u00E9 prostory p\u0159\u00EDstupn\u00E9 ve\u0159ejnosti, prost\u0159edky ve\u0159ejn\u00E9 dopravy, ve\u0159ejn\u011B p\u0159\u00EDstupn\u00E9 prostory budov souvisej\u00EDc\u00ED s ve\u0159ejnou dopravou, n\u00E1stupi\u0161t\u011B, p\u0159\u00EDst\u0159e\u0161ky a \u010Dek\u00E1rny ve\u0159ejn\u00E9 silni\u010Dn\u00ED a dr\u00E1\u017En\u00ED dopravy a m\u011Bstsk\u00E9 hromadn\u00E9 dopravy, s v\u00FDjimkou stavebn\u011B odd\u011Blen\u00FDch prostor ke kou\u0159en\u00ED vyhrazen\u00FDch a p\u0159i pobytu osob trvale v\u011Btran\u00FDch do prostor mimo budovu,

e) ve vnit\u0159n\u00EDch prostor\u00E1ch zdravotnick\u00FDch za\u0159\u00EDzen\u00ED v\u0161ech typ\u016F, s v\u00FDjimkou uzav\u0159en\u00FDch psychiatrick\u00FDch odd\u011Blen\u00ED nebo jin\u00FDch za\u0159\u00EDzen\u00EDch pro l\u00E9\u010Dbu z\u00E1vislost\u00ED, a to v prostor\u00E1ch, kter\u00E9 jsou stavebn\u011B odd\u011Blen\u00E9 a p\u0159i pobytu osob s mo\u017Enost\u00ED v\u011Btr\u00E1n\u00ED do prostor mimo budovu.

(2) V budov\u00E1ch st\u00E1tn\u00EDch org\u00E1n\u016F, org\u00E1n\u016F \u00FAzemn\u00EDch samospr\u00E1vn\u00FDch celk\u016F, za\u0159\u00EDzen\u00ED z\u0159\u00EDzen\u00FDch st\u00E1tem nebo \u00FAzemn\u00EDm samospr\u00E1vn\u00FDm celkem poskytuj\u00EDc\u00EDch ve\u0159ejn\u00E9 slu\u017Eby a finan\u010Dn\u00EDch instituc\u00ED v\u010Detn\u011B jejich za\u0159\u00EDzen\u00ED spole\u010Dn\u00E9ho stravov\u00E1n\u00ED, jsou osoby pov\u011B\u0159en\u00E9 jejich \u0159\u00EDzen\u00EDm povinny zajistit, aby ob\u010Dan\u00E9 byli v t\u011Bchto budov\u00E1ch chr\u00E1n\u011Bni p\u0159ed \u0161kodami p\u016Fsoben\u00FDmi kou\u0159en\u00EDm. Ustanoven\u00ED odstavce 1 t\u00EDm nen\u00ED dot\u010Deno.

(3) Prostory vyhrazen\u00E9 pro ku\u0159\u00E1ky mus\u00ED jejich provozovatel ozna\u010Dit zjevn\u011B viditeln\u00FDm n\u00E1pisem \u201EProstor vyhrazen\u00FD pro kou\u0159en\u00ED\u201C nebo jin\u00FDm obdobn\u00FDm zp\u016Fsobem.

\r\n

(4) Ve ve\u0159ejn\u00E9 dr\u00E1\u017En\u00ED doprav\u011B mus\u00ED b\u00FDt v ka\u017Ed\u00E9m vlaku za\u0159azena alespo\u0148 polovina voz\u016F bez prostor vyhrazen\u00FDch ke kou\u0159en\u00ED.

\r\n

(1) Na m\u00EDstech, kde je podle \u00A7 8 zak\u00E1z\u00E1no kou\u0159it, je provozovatel povinen um\u00EDstit u vstupu zjevn\u011B viditeln\u00FD text z\u00E1kazu kou\u0159en\u00ED, kter\u00FD mus\u00ED b\u00FDt po\u0159\u00EDzen v \u010Desk\u00E9m jazyce \u010Dern\u00FDmi tiskac\u00EDmi p\u00EDsmeny na b\u00EDl\u00E9m podklad\u011B na plo\u0161e o velikosti p\u00EDsma nejm\u00E9n\u011B 5 cm, a grafickou zna\u010Dku z\u00E1kazu kou\u0159en\u00ED, jejich\u017E vzhled je stanoven zvl\u00E1\u0161tn\u00EDm pr\u00E1vn\u00EDm p\u0159edpisem<span class=\"poznamka-link\" resource=\"footnote/9\"><sup>9</sup>)</span>.

\r\n

(2) Nedodr\u017Euje-li osoba z\u00E1kaz kou\u0159en\u00ED v m\u00EDstech uveden\u00FDch v \u00A7 8 odst. 1 a 2, a to ani po v\u00FDzv\u011B provozovatele, aby v tomto jedn\u00E1n\u00ED nepokra\u010Dovala nebo aby prostor opustila, je provozovatel opr\u00E1vn\u011Bn po\u017E\u00E1dat obecn\u00ED policii, nebo Policii \u010Cesk\u00E9 republiky o z\u00E1krok sm\u011B\u0159uj\u00EDc\u00ED k dodr\u017Een\u00ED z\u00E1kazu.

(1) Alkoholick\u00E9 n\u00E1poje lze prod\u00E1vat pouze

a) ve specializovan\u00FDch prodejn\u00E1ch alkoholick\u00FDch n\u00E1poj\u016F,

\r\n

b) ve specializovan\u00FDch odd\u011Blen\u00EDch velkoplo\u0161n\u00FDch prodejen ur\u010Den\u00FDch k prodeji alkoholick\u00FDch n\u00E1poj\u016F, v prodejn\u00E1ch potravin a sm\u00ED\u0161en\u00FDch prodejn\u00E1ch, nebo

\r\n

(2) Ustanoven\u00ED odstavce 1 se nevztahuje na p\u0159\u00EDle\u017Eitostn\u00FD prodej rozl\u00E9van\u00FDch alkoholick\u00FDch n\u00E1poj\u016F p\u0159i slavnostech, tradi\u010Dn\u00EDch akc\u00EDch, v\u00FDro\u010Dn\u00EDch trz\u00EDch a jim podobn\u00FDch akc\u00EDch.

Omezen\u00ED prodeje a dovozu

\r\n

(1) Zakazuje se prodej a dovoz hra\u010Dek napodobuj\u00EDc\u00EDch tvar a vzhled alkoholick\u00FDch n\u00E1poj\u016F.

\r\n

Ve\u0161ker\u00E9 dal\u0161\u00ED formy prodeje, p\u0159i kter\u00FDch nen\u00ED mo\u017Eno ov\u011B\u0159it v\u011Bk kupuj\u00EDc\u00EDho, se zakazuj\u00ED.

Text mus\u00ED b\u00FDt po\u0159\u00EDzen v \u010Desk\u00E9m jazyce \u010Dern\u00FDmi tiskac\u00EDmi p\u00EDsmeny na b\u00EDl\u00E9m podklad\u011B o velikosti p\u00EDsma nejm\u00E9n\u011B 5 cm.

Vy\u0161et\u0159en\u00ED p\u0159\u00EDtomnosti alkoholu nebo jin\u00E9 n\u00E1vykov\u00E9 l\u00E1tky

\r\n

(1) Osoba, kter\u00E1 vykon\u00E1v\u00E1 \u010Dinnost, p\u0159i n\u00ED\u017E by mohla ohrozit \u017Eivot nebo zdrav\u00ED svoje nebo dal\u0161\u00EDch osob nebo po\u0161kodit ciz\u00ED majetek, nesm\u00ED po\u017E\u00EDvat alkoholick\u00E9 n\u00E1poje nebo u\u017E\u00EDvat jin\u00E9 n\u00E1vykov\u00E9 l\u00E1tky p\u0159i v\u00FDkonu t\u00E9to \u010Dinnosti nebo p\u0159ed jej\u00EDm vykon\u00E1v\u00E1n\u00EDm.

\r\n

(2) Odborn\u00E9mu vy\u0161et\u0159en\u00ED zji\u0161\u0165uj\u00EDc\u00EDmu obsah alkoholu nebo jin\u00FDch n\u00E1vykov\u00FDch l\u00E1tek v\u010Detn\u011B odb\u011Bru biologick\u00E9ho materi\u00E1lu k jeho stanoven\u00ED je povinna podrobit se osoba, kter\u00E1 se po\u017Eit\u00EDm t\u011Bchto l\u00E1tek uvedla do stavu, v n\u011Bm\u017E bezprost\u0159edn\u011B ohro\u017Euje sebe nebo jin\u00E9 osoby, ve\u0159ejn\u00FD po\u0159\u00E1dek nebo majetek, d\u00E1le osoba, u kter\u00E9 je d\u016Fvodn\u00E9 podez\u0159en\u00ED, \u017Ee p\u0159ivodila jin\u00E9mu \u00FAjmu na zdrav\u00ED v souvislosti s po\u017Eit\u00EDm alkoholick\u00E9ho n\u00E1poje nebo u\u017Eit\u00EDm jin\u00E9 n\u00E1vykov\u00E9 l\u00E1tky.

\r\n

(3) Osoba uveden\u00E1 v odstavc\u00EDch 1 a 2 je povinna podrobit se na v\u00FDzvu p\u0159\u00EDslu\u0161n\u00EDk\u016F Policie \u010Cesk\u00E9 republiky, obecn\u00ED policie, Vojensk\u00E9 policie, V\u011Bze\u0148sk\u00E9 slu\u017Eby \u010Cesk\u00E9 republiky, zam\u011Bstnavatele nebo jej\u00EDho o\u0161et\u0159uj\u00EDc\u00EDho l\u00E9ka\u0159e vy\u0161et\u0159en\u00ED, zda nen\u00ED ovlivn\u011Bna alkoholem nebo jinou n\u00E1vykovou l\u00E1tkou.

\r\n

(4) Orienta\u010Dn\u00ED vy\u0161et\u0159en\u00ED prov\u00E1d\u00ED \u00FAtvar Policie \u010Cesk\u00E9 republiky, obecn\u00ED policie, Vojensk\u00E9 policie, V\u011Bze\u0148sk\u00E1 slu\u017Eba \u010Cesk\u00E9 republiky a zam\u011Bstnavatel pomoc\u00ED dechov\u00E9 zkou\u0161ky, pop\u0159\u00EDpad\u011B odb\u011Bru slin. L\u00E9ka\u0159sk\u00E9 vy\u0161et\u0159en\u00ED prov\u00E1d\u00ED zdravotnick\u00E9 za\u0159\u00EDzen\u00ED k tomu odborn\u011B a provozn\u011B zp\u016Fsobil\u00E9 dechovou zkou\u0161kou a odb\u011Bry vzork\u016F biologick\u00E9ho materi\u00E1lu.

\r\n

(5) Odm\u00EDtne-li se osoba uveden\u00E1 v odstavc\u00EDch 1 a 2 vy\u0161et\u0159en\u00ED podle odstavce 4 podrobit, hled\u00ED se na ni, jako by byla pod vlivem alkoholu nebo jin\u00E9 n\u00E1vykov\u00E9 l\u00E1tky.

\r\n

(6) Zdravotnick\u00E1 za\u0159\u00EDzen\u00ED k tomu odborn\u011B a provozn\u011B zp\u016Fsobil\u00E1 jsou povinna poskytnout zam\u011Bstnavateli, \u00FAtvar\u016Fm policie a V\u011Bze\u0148sk\u00E9 slu\u017Eb\u011B \u010Cesk\u00E9 republiky pot\u0159ebnou pomoc proveden\u00EDm odb\u011Bru biologick\u00E9ho materi\u00E1lu.

\r\n

(7) Zdravotnick\u00E9 za\u0159\u00EDzen\u00ED je povinno sd\u011Blit v\u00FDsledky vy\u0161et\u0159en\u00ED subjekt\u016Fm uveden\u00FDm v odstavci 3 na z\u00E1klad\u011B jejich \u017E\u00E1dosti. To neplat\u00ED, je-li pacient vy\u0161et\u0159ov\u00E1n na p\u0159\u00EDtomnost alkoholu nebo jin\u00E9 n\u00E1vykov\u00E9 l\u00E1tky v organismu pouze v souvislosti s poskytovanou zdravotn\u00ED p\u00E9\u010D\u00ED pro diferenci\u00E1ln\u00ED diagnostiku.

\r\n

(8) Vy\u0161et\u0159en\u00ED biologick\u00E9ho materi\u00E1lu hrad\u00ED v p\u0159\u00EDpad\u011B, \u017Ee se prok\u00E1\u017Ee p\u0159\u00EDtomnost alkoholu nebo jin\u00E9 n\u00E1vykov\u00E9 l\u00E1tky, vy\u0161et\u0159ovan\u00E1 osoba. V p\u0159\u00EDpad\u011B, \u017Ee se p\u0159\u00EDtomnost alkoholu nebo jin\u00E9 n\u00E1vykov\u00E9 l\u00E1tky neprok\u00E1\u017Ee, n\u00E1klady nese osoba, kter\u00E1 podle odstavce 3 k vy\u0161et\u0159en\u00ED vyzvala, s v\u00FDjimkou p\u0159\u00EDpad\u016F diferenci\u00E1ln\u00ED diagn\u00F3zy hrazen\u00E9 z ve\u0159ejn\u00E9ho zdravotn\u00EDho poji\u0161t\u011Bn\u00ED podle zvl\u00E1\u0161tn\u00EDho pr\u00E1vn\u00EDho p\u0159edpisu<span class=\"poznamka-link\" resource=\"footnote/10\"><sup>10</sup>)</span>.

O\u0161et\u0159en\u00ED v protialkoholn\u00ED a protitoxikomanick\u00E9 z\u00E1chytn\u00E9 stanici

\r\n

(1) Protialkoholn\u00ED a protitoxikomanick\u00E1 z\u00E1chytn\u00E1 stanice (d\u00E1le jen \u201Ez\u00E1chytn\u00E1 stanice\u201C) je zdravotnick\u00E9ho za\u0159\u00EDzen\u00ED, kter\u00E9 z\u0159izuje \u00FAzemn\u011B samospr\u00E1vn\u00ED celek, kter\u00FD m\u016F\u017Ee v samostatn\u00E9 p\u016Fsobnosti zaji\u0161\u0165ovat p\u00E9\u010Di poskytovanou v tomto za\u0159\u00EDzen\u00ED t\u00E9\u017E smluvn\u011B, a to tak, aby na cel\u00E9m jeho \u00FAzem\u00ED byla zaji\u0161t\u011Bna z\u00E1chytn\u00E1 slu\u017Eba s dojezdovou vzd\u00E1lenost\u00ED do 45 minut.

\r\n

(2) Pokud je klinick\u00FDm a laboratorn\u00EDm vy\u0161et\u0159en\u00EDm zji\u0161t\u011Bno, \u017Ee o\u0161et\u0159ovan\u00E1 osoba nen\u00ED ohro\u017Eena na \u017Eivot\u011B selh\u00E1n\u00EDm z\u00E1kladn\u00EDch \u017Eivotn\u00EDch funkc\u00ED, ale pod vlivem alkoholu nebo jin\u00E9 n\u00E1vykov\u00E9 l\u00E1tky nekontroluje sv\u00E9 chov\u00E1n\u00ED, a t\u00EDm bezprost\u0159edn\u011B ohro\u017Euje sebe nebo jin\u00E9 osoby, ve\u0159ejn\u00FD po\u0159\u00E1dek nebo majetek, nebo je ve stavu vzbuzuj\u00EDc\u00EDm ve\u0159ejn\u00E9 pohor\u0161en\u00ED, je tato osoba povinna se podrobit o\u0161et\u0159en\u00ED a pobytu v z\u00E1chytn\u00E9 stanici po dobu nezbytn\u011B nutnou k odezn\u011Bn\u00ED akutn\u00ED intoxikace.

\r\n

(3) Dopravu osob do z\u00E1chytn\u00E9 stanice zabezpe\u010Duje osoba, kter\u00E1 podle \u00A7 16 odst. 3 k vy\u0161et\u0159en\u00ED vyzvala. V p\u0159\u00EDpad\u011B, \u017Ee touto osobou je p\u0159\u00EDslu\u0161n\u00EDk obecn\u00ED policie, dopravu zabezpe\u010Duje Policie \u010Cesk\u00E9 republiky.

\r\n

(4) Dopravu, vy\u0161et\u0159en\u00ED, o\u0161et\u0159en\u00ED a n\u00E1sledn\u00FD pobyt na z\u00E1chytn\u00E9 stanici hrad\u00ED v p\u0159\u00EDpad\u011B, \u017Ee se prok\u00E1\u017Ee p\u0159\u00EDtomnost alkoholu nebo jin\u00E9 n\u00E1vykov\u00E9 l\u00E1tky, o\u0161et\u0159en\u00E1 osoba. V p\u0159\u00EDpad\u011B, \u017Ee se p\u0159\u00EDtomnost alkoholu nebo jin\u00E9 n\u00E1vykov\u00E9 l\u00E1tky neprok\u00E1\u017Ee, n\u00E1klady nese osoba, kter\u00E1 podle \u00A7 16 odst. 3 k vy\u0161et\u0159en\u00ED vyzvala, s v\u00FDjimkou p\u0159\u00EDpad\u016F diferenci\u00E1ln\u00ED diagn\u00F3zy hrazen\u00E9 z ve\u0159ejn\u00E9ho zdravotn\u00EDho poji\u0161t\u011Bn\u00ED podle zvl\u00E1\u0161tn\u00EDho pr\u00E1vn\u00EDho p\u0159edpisu.

\r\n

(5) O\u0161et\u0159en\u00ED osoby p\u0159ijat\u00E9 na z\u00E1chytnou stanici oznamuje z\u00E1chytn\u00E1 stanice jej\u00EDmu registruj\u00EDc\u00EDmu praktick\u00E9mu l\u00E9ka\u0159i. Jde-li o osobu mlad\u0161\u00ED 18 let, oznamuje se tato skute\u010Dnost tak\u00E9 jej\u00EDmu z\u00E1konn\u00E9mu z\u00E1stupci, pop\u0159\u00EDpad\u011B jin\u00E9 osob\u011B odpov\u011Bdn\u00E9 za jej\u00ED v\u00FDchovu. P\u0159i p\u0159ijet\u00ED osoby mlad\u0161\u00ED 18 let se tato skute\u010Dnost oznamuje t\u00E9\u017E org\u00E1nu soci\u00E1ln\u011B-pr\u00E1vn\u00ED ochrany d\u011Bt\u00ED. Jde-li o osobu s omezenou zp\u016Fsobilost\u00ED k pr\u00E1vn\u00EDm \u00FAkon\u016Fm nebo zbavenou zp\u016Fsobilosti k pr\u00E1vn\u00EDm \u00FAkon\u016Fm, oznamuje se tato skute\u010Dnost opatrovn\u00EDkovi ur\u010Den\u00E9mu soudem<span class=\"poznamka-link\" resource=\"footnote/11\"><sup>11</sup>)</span>.

P\u0159i stanoven\u00ED sankce se p\u0159ihl\u00E9dne k d\u00E9lce doby, po kterou poru\u0161ov\u00E1n\u00ED povinnosti trvalo, k okolnostem, za nich\u017E k protipr\u00E1vn\u00EDmu jedn\u00E1n\u00ED do\u0161lo a k n\u00E1sledk\u016Fm tohoto jedn\u00E1n\u00ED.
