"Those municipalities, that have their zoning plans issued before 2006, are obliged under the Building Act to issue a new zoning plan in accordance with the new legislation till the end of 2015. Since a number of them have not yet done so, an increase in activity in this field can be expected in the near future. Zoning plans are issued in the form of a general binding measure. The process of their preparation is quite complicated, thus municipality in the course of it might commit a number of mistakes that can cause the illegality of zoning plan or part thereof. For this reason, it may be wholly or partly cancelled in the review proceedings or by administrative court after an action brought against such zoning plan. The Supreme Administrative Court has established in its jurisprudence a certain algorithm for review of zoning plans. Thus, defects which are to be deemed as essential can be generalized from individual court cases, as well as which errors may still be tolerated. The most common reason for the abolition of zoning plans are procedural errors, particularly poor settlement of objections, failure to ensure the necessary supporting documents for the issue of a zoning plan, and public hearing defects. This article aims to analyze the various procedural failures and provide certain guidance on how to properly lead the process and bring it to a successfully issued zoning plan."@en . "1"^^ .
