This research project deals with the issues connected to the relationship between labour law (the function of which is to protect an employee against negative effects caused by the long-term performance of dependent work; because of this protective function, labour law is classified as a compartment of the State social policy) and civil law (which governs, in principle, solely relationships between natural and legal persons associated with real and personal property). The Czech Labour Code of 2006 set forth %22the principle of express enumeration of civil law provisions applicable to labour relations%22 (so called delegation principle), which maintains a unique position among European legal approaches. For example, Slovakia, Germany and Austria prefer the principle of subsidiarity, but Slovakia only in relation to the general principles of employment law. The clash between subsidiarity and delegation is connected to the State social policy and the level of development of civil society and political culture. The objective of this research is to examine respective doctrines and regulations issued by the Czech Republic, its predecessors, and at least five other Member States of EU. The project will include a conclusion with suggestions leading to the improvement of Czech regulations.
