The purpose of marriage is the foundation of the family, which to this time was based on the principle of certainty of the mother and uncertainty of the father. Causes of childlessness in marriage are both biological (realated to health) as well as social. In the last few decades there has been a refinement of artificial human reproduction. In vitro fertilization of the donated germ cell soon become a matter of routine on specialized clinics and it does not cause any fundamental legal issues. In contrast, significant problems brings surrogacy, in which the fertilized germ cells, belonging almost always to the partner, are inserted into the uterus of another woman, who will carry and give birth to the child. It is a procedure inadmissible, but uninhibited.
