Cílem projektu je zmapovat problematiku právní ochrany nezletilých osob v raně novověkém období v českém prostředí, popsat systém fungování ochrany dítěte v rodině i mimo ni včetně instituce poručenství a postihnout historický vývoj obou těchto systému v rovině městského a zemského práva. The aim of this project is add law perspective to the knowledge of history of children and family in the Early Modern Period. The research inquires the fundamental elements of the legal protection of under-age children inside and outside the family, the mechanism of orphans´ tutelage and last but not least the historical progress of both of these topics. The main sources of this historically and legally oriented research are condifications of the city and municipal law from the Early Modern Period till the issue of the Civil Code in 1811 together with the official sources from the same period saved in Czech and Moravian archives. We expect that the result will answer the questions about interaction between city and municipal law during the codifications process, about the acceptance of foreign elements from the German, Austrian and Roman Law and about autochthonic origin of some rules of law.The main result of the project will be a book with selective edition of sources and several articles published during the research period.
