Description
  • The aim of the first part of this article is to expose the doctrine of Orthodox theologians on divorce. In general, they acknowledge the indissolubility of marriage as one of the attributes of marriage itself, but at the same time they admit exceptions in the praxis. They justify the divorce variously, but generally it can be said that diverse causes of divorce are different modes of %22death%22 of the marriage. In the second part the article introduces and enumerates the various causes of divorce in the Orthodox doctrine, set by Justinians Novell 117 and then adopted by the canon digest Nomocanon of 14 titles.   • Scopo della prima parte dell'articolo ? presentare la dottrina dei teologi ortodossi sul divorzio. Essi generalmente indicano l'indissolubilita del matrimonio come una delle caratteristiche principali del matrimonio medesimo; ammettono pero, nell'ambito della prassi, delle eccezioni. Gli autori ortodossi giustificano il divorzio in modi differenti; in generale, comunque, puo dirsi che le possibili varie cause di divorzio sono individuabili nei diversi modi di %22morte%22 del matrimonio. Nella parte seconda, poi, l'articolo presenta le singole cause di divorzio nella dottrina ortodossa, codificate nella novella 117 di Giustiniano e poi recepite nel Nomocanone di 14 titoli.
