Description
  • The paper also treat of whether starting on maternity leave is right or obligation of employee's, and considering possible legal consequences in a situation where a woman on maternity leave does not compete. The aim of maternity leave is to protect healthy child development and health of pregnant women. The protective function occurs in these questions. The employer is obliged to excuse an employee from work (the legal claim of each such woman to time off without it was obligated for maternity leave to apply separately and meet other conditions, it is sufficient to prove the existence of obstacles). It is prohibited the notice during pregnancy and maternity leave (except for organizational changes) and prohibit immediate termination of employment during pregnancy and maternity leave. After returning from maternity leave is entitled the employee to the same job. The employer is obliged to assign the employees original work and workplace. This legal regulation is a benefit for employees on maternity leave, for example, compared to those that draw the parental leave (up to three years of age of child) in the direction that the law guarantees them perform their original work on the original site. During maternity leave women are entitled to social security in the form of maternity benefits, possibly parental contribution.
