  • Bankruptcy and nonprofit bankrutpcy and their main pieces of legal regulation are extremely useful both for creditors and debtors and as well as for specialists. This paper brings a new approach to the view of various national states and their impact on the application of collective insolvency proceedings. For creditors is rare to get back much of their money because entrepreneurial subject enter into insolvency proceedings with a very small amount of assets compared to their liabilities. The entire proces takes very long a the goal of the trustee is to pay back creditors but the recovery rate is very low or creditors get nothing. Business can be placed under court protection from creditors in blocking enforcement and increasing interest and penalties, allowing them a new start through a reorganization of their activities. By creditors may be used an aggressive insolvency procedure in order to obtain a quick settlement of their receivables from solvent borrowers. Nonprofits can declare either bankruptcy but it has not been common, because most choose to close instead. For better using the financial rehabilitation principle to achieve adequate fulfilment during insolvency proceedings would be to tighten present regulations regarding the possibilities of indebting a business.
