Description	This article deals with the issue of contemporary meaning and sense of so called Radbruchs formula in the work of a German legal theoretician and philosopher Robert Alexy. The authors have proceeded from the ontological features of the formula as Alexy puts them in his recent articles, i. e. On the Concept and Nature of Law (cited in the text). On the other hand, methodological importance of the formula cannot be overseen. Alexy interprets the formula in an actual way and shows that the formula has normative quality. Therefore, it suggests an answer for hard cases in which a conflict between statutory law (positive law) and justice (a non-positive legal standard) shall be resolved. Two main examples of application of the formula are remembered in the article. The main scope of the article is to show Radbruchs formula is not only a historical instrument, but a valid part of legal methodology which can be used in specific cases of extreme injustice. (en) Tento článek se zabývá problémem současného významu a funkce Radbruchovy formule v díle současného právního teoretika a filosofa Roberta Alexyho. Představuje ontologické i metodologické aspekty této právně filosofické ideové konstrukce vztahu práva a spravedlnosti. Hlavním cílem této stati je ukázat, že Radbruchova formule je není pouze historickým právním jevem, nýbrž součástí právní metodologie použitelnou v případech extrémní nespravedlnosti platného práva. Tento článek se zabývá problémem současného významu a funkce Radbruchovy formule v díle současného právního teoretika a filosofa Roberta Alexyho. Představuje ontologické i metodologické aspekty této právně filosofické ideové konstrukce vztahu práva a spravedlnosti. Hlavním cílem této stati je ukázat, že Radbruchova formule je není pouze historickým právním jevem, nýbrž součástí právní metodologie použitelnou v případech extrémní nespravedlnosti platného práva.
