Description	This article deals with the issue of protection of the most critical national infrastructure in respect of the validity of the new legislation. Current security risks have brought a need the critical infrastructure to be defined as such area of the national infrastructure whose impairment or substantial damage would lead to serious economic and political consequences. In January 2011, a new update of Act no. 240/2000 Col. on crisis management linked to the pertinent documents of EU for crisis management area came into force; this update is dealing with setting the framework of the elements of National critical infrastructure and assurance of their protection. Conclusion of this article deals with different opinions of experts concerning the protection of critical infrastructure right from the perspective of the new legislation.
