Description	The objective of the research will result from elaborating on the basic theoretical concepts of Criminal Law and Criminal Procedure as the base of legislative work. The concept of a crime, its material and formal understanding, its structure, the system of punishement and sentencing rules, more efficient regulation of Criminal Procedure, including possible deviation in the proceedings, are the most important issues in the branch. The aim will be to provide the legislature with the necessary documentary materials for the new regulation of the Criminal Code and the Rules of Criminal Procedure. The outcomes will be implemented by means of the participation of the researchers in the relevant working teams. (en) Výzkumný záměr vychází z rozpracování základních teoretických pojmů trestního práva hmotného a procesního, jako východiska pro legislativní práce. Pojem trestných činů, jejich materiální či formální pojetí, jejich struktura, systém trestů a zásady jejichukládání, efektivnější úprava trestního procesu, včetně možných odklonů v řízení, to jsou dnes nejzávažnější otázky oboru. Cílem je poskytnout legislativním orgánům potřebné podklady pro novou úpravu trestního zákona a trestního řádu. Výstupy se budou realizovat též účastí řešitelů v příslušných pracovních týmech.
